General terms and conditions/Privacy Policy

§ 1 General

These standard Terms and Conditions shall form an integral part of all delivery contracts, agreements and offers and shall be binding upon the placement of an order or acceptance of delivery. All agreements shall be stipulated in writing.

§ 2 Conclusion of Contract

The offer of products on the websites of Allergie-Immun are not an offer to conclude a contract, it  merely summons for the buyer to submit a bid. The purchaser is – subject to revocation – binded to his/her offer for the duration of two weeks upon ordering. Contract is binding on terms of Allergie-Immun accepting offers of the buyer either by fax or email or shipping the ordered products within this two week period.

§ 3 Revocation/Recall of Order

The buyer has the right to revoke his/her order within the following guidelines:

You shall have the right to revoke your binding order – unless right of revocation is not excluded under terms of subparagraph 3 – within two (2) weeks of placing your order, via mail, fax or letter or by returning the ordered product. No grounds need to be given. The two-week deadline shall begin upon receipt of indoctrination of the content of this written document. Should this indoctrination take place after concluding contract then the deadline (at variance with clause 1) is four (4) weeks. A revocation shall be deemed timely so long as it is dispatched before the deadline. Revocation and/or products are to be send to the following mail address:

2. Possible Consequence of Revocation

In case of a valid revocation any payments received are to be credited less any already used portion. If you are not able  to replace benefits fully or partially, or if the value of the products has been diminished in any way, you are required to compensate Allergie-Immun. This may be avoided by not commencing to use the products as an owner would and to avoid any action that might lessen the value of the products. The cost of return shipping will be at your risk and expense if the delivered goods are equal to the those ordered and if the price of the returned product is not more than € 40 or if, at a higher price, you have not returned benefits at time of revocation or rendered partial payment. In any other case return shipments are free of charge.

3. Right of Revocation

There is no right of revocation if the products are produced in accordance with the clients´ specification or if they are expressly tailored to the personal requirements. There is no right of revocation if they are not fit for return due to their condition or are highly perishable, or if their expiry date has been exceeded. Our products are offered in sealed bottles and have been bottled at high hygienic standard and are therefore not tradable after opening and may not be returned.

§ 4 Delivery

Deliveries are shipped to the address of delivery as requested and indicated by the buyer and to the recipient known by name (actual person). They are shipped through a dispatcher that is instructed by Allergie-Immun. Allergie-Immun reserves the right to partial deliveries at no additional cost to the buyer.

§ 5 Terms and Conditions of Payment

Payments are due from the date of order and shall be credited to Allergie-Immun according to the amount stated on the invoice. All prices include legal taxes (VAT) .Cost of packaging and shipping is additional.

§ 6 Reservation of Title

All delivered products remain property of Allergie-Immun until payment is complete for all existing claims resulting from this business transaction.

§ 7 Set-Off

The buyer only has the right to offset positions if counterclaims are legally assessed or uncontested by Allergie-Immun.

§ 8 Liability

Except for a) cases of proven negligence, fraud or breach of obligation to its full extent; b)all other cases only by breach of duty necessary for the purpose of the contract(cardinal duty) its refund in full limited to causes of damage and damage foreseeable at the time the contract is concluded; liability of Allergie-Immun contractually and non-contractually – including possible defects as to quality or title - shall be limited. Cases of bodily injury and those affected by the product liability law (Produkthaftungsgesetz) shall remain unaffected in any case. Allergie-Immun is referring to other websites on its Internet pages. Allergie-Immun has no influence whatsoever on the layout or content of these pages. Therefore Allergie-Immun shall not be liable for the currentness, accuracy and quality of information presented in these pages.

§ 9 Data Privacy

The buyer has been fully informed by Allergie-Immun of and explicitly approves by placing an order that all necessary data needed for processing the order are saved and treated confidentially observing the Federal Data Protection Act (Bundesdatenschutzgesetz). The buyer formally agrees to commencement, processing and application of his/her personal data for the above mentioned purpose. As for the future, the buyer may revoke this approval at any time. In this case Allergie-Immun is obligated to promptly delete any personal data, provided that all previous orders have been completely processed. Allergie-Immun reserves the right to use a dispatcher and delegate all rights and duties of this agreement to this dispatcher. For the purpose of credit rating, Allergie-Immun has the right to pass on personal data to third parties.

§ 10 Governing law and Place of Jurisdiction

All disputes arising out or in connection with these Conditions or this Contract shall be governed by the substantive laws of Germany excluding the applicaton of CISG (UN-Kaufrecht). The arbitration shall take place in Bobenheim am Berg if the client is a merchandiser or does not hold a national place of jurisdiction.

§ 11 Salvatorious clause

The effectiveness of settlements remain unaffected by the influence of one or more settlements stated in these “Terms and Conditions”. The effectiveness of the Contract in particular remains unaffected by the ineffectiveness of one or more settlements.
